Martinez Wife Accidentally Runs Over and Kills Husband

By Kelly Balamuth on July 30, 2015

On the morning of Wednesday July 28th, an elderly woman who mistook the gas pedal for the brake in her Toyota Corolla ran over and killed her husband. The accident occurred on the 600 block of Reliez Valley Road near the border of Martinez, according to NBC Bay Area News. The husband was giving directions for repositioning the car in the driveway when the wrong pedal was pushed, crashing into the garage and pinning him underneath.

The man was able to provide a statement to the Martinez police that validated his wife’s statement. Unfortunately, he succumbed to his injuries while being treated at John Muir Hospital a few hours after the accident. The accident remains under investigation by the CHP.

There are substantial emotional injuries from the loss of a family member in a fatal accident. Whoever causes another person to be injured or killed can be held liable for damages. However, situations like what happened in Martinez could be classified as an accidental killing. This means the death was caused by actions which against the law and done under a reasonable belief that no harm is possible in the situation.
