Summary:
A baby was born at a hospital. During the birth, he suffered from pre-delivery asphyxia which resulted in Hypoxic Ischemic Encephalopathy. The hospital should have performed an emergency cesarian section, but instead allowed the baby to be born vaginally, resulting in an essential partial suffocation of the baby. In their claims against the hospital, plaintiffs claimed that the conduct of the physicians and nurses fell well below the applicable standards of care for treating pre-delivery asphyxia.

Carol Doe v. Doe Doctor
Carol Doe v. Doe Medical Group; Doe HMO
Summary:
Defendant doctor unnecessarily removed the ovaries of a 29 year old woman, which later caused the need for an emergency hysterectomy. During the hysterectomy, the doctor sliced into the woman's bladder several times, requiring extensive surgeries to repair it. The doctor had a criminal record which had led California's medical licensing board to impose probation of his license to practice medicine. Nonetheless, the medical group and the HMO kept the doctor on their list of "preferred" providers. Plaintiffs sued the doctor for the two negligent surgeries and the medical group and the HMO for keeping the doctor on their list of providers.

Summary:
Defendant's employee made an illegal lane change on the freeway propelling the plaintiff from the highway and causing her car to roll. Kelly Doe v. Hospital
Summary:
Kelly Doe went to Hospital for a routine endoscopic sinus surgery to remove some nasal polyps.  The surgeon became confused and broke through her cribriform plate in her skull, causing intracranial bleeding and permanent mild brain damage.  The puncture caused permanent impairment to plaintiff’s memory, decision making, and multi-tasking abilities.  (Note: Plaintiff was only entitled to recover $250,000 from Hospital for her pain and suffering because California law caps what a victim in a medical malpractice case can recover for pain and suffering to just $250,000.)

Steve Doe v. Grocery Chain
Summary:
The plaintiff was a firefighter. He went to an Albany grocery store to respond to a warehouse fire. In the midst of fighting the fire, the plaintiff was forced to exit the loading dock by jumping off the dock because defendant had blocked the only other means of egress, a ladder, with a dumpster. His fire fighting gear caught on the dock, and he fell suffering severe spinal injuries. The plaintiff sued the grocery chain, alleging that it was negligent for blocking the exit.

Case Name:
Mr. & Mrs. Doe v. Psychiatric Facility
Summary:
Plaintiff, a carpenter with no history of mental illness, developed depression. He admitted himself to an acute care psychiatric facility, where he was admitted to a locked unit. Plaintiff told a mental health technician that he wanted to leave the facility. In direct violation of hospital policy, the technician did not report plaintiff's statement to the charge nurse nor to the treating psychiatrist. Plaintiff became increasingly agitated and distraught. He removed the end of his bed, went to his window, and repeatedly slammed it into the glass. After several minutes, the glass shattered and he jumped. Plaintiff suffered a complete burst fracture of T12, bilateral pneumothoraces and a complete spinal cord injury at T12-L1 (meaning paraplegia). The plaintiffs sued defendant for negligence.

Summary:
The plaintiff doctor owned medical clinics in Sacramento and San Leandro. He hired a law firm to represent him in selling their medical clinics. As part of the sale, plaintiff was to receive first priority security interests in certain assets being sold. The defendant law firm failed to perfect these security interests. The buyer repeatedly defaulted on its obligations to plaintiff. Protracted negotiations and threats of bankruptcy ensued. As a result, plaintiff sold assets for over a million dollars, but recovered assets valued at far less.

Mrs. Doe v.  Neighbor
Summary:
Mr. Doe (deceased) approached his neighbor and started a heated argument over a parking spot.  The argument escalated and the neighbor punched Mr. Doe, who fell and struck his head against the concrete sidewalk. Mr. Doe sustained fatal injuries from the head trauma.  After filing a lawsuit, Mrs. Doe recovered the policy limits of the neighbor’s homeowner’s insurance policy.

Summary:
Plaintiff had just finished her night shift as a restaurant manager and was walking in a crosswalk to a bus stop.  As plaintiff walked across a marked crosswalk, Driver struck her at 25 miles per hour. Summary:
Driver negligently pulled out from a stop sign into the path of Sara Doe, who was traveling 45 miles per hour in her Jeep (plaintiff did not have a stop sign or traffic light facing her).  The impact caused plaintiff’s Jeep to roll over twice.  She suffered head and back injuries as a result.

Case Name:
Terry Doe v. Subcontractor; General Contractor
Summary:
Plaintiff worked as a journeyman plumber. As part of his job, he was installing the gas system on a two story house. The house was rough framed and two stories tall. A stairway connected the second floor to the living room area. A person descending from the second floor would take two steps down to a small landing, then turn right and descend approximately ten additional steps to the living room. The defendant subcontractor was to provide all blocking and backing including stair railing, and was to install interior and exterior stairs, including temporary railing. Additionally, the subcontractor was to provide and install rough hardware, including the nails used to install the temporary railing. Plaintiff descended the stairs to the landing carrying a large ladder over his shoulder. He lost his balance and attempted to steady himself against the guardrail, which gave way. He fell eight to ten feet, slamming onto the living room floor and suffering a serious shoulder injury. Plaintiff sued defendants for negligence because the railing had been secured by only a single nail into the wall next to the landing.

Jack Doe v. Oil Refinery, Inc.
Summary:
Plaintiff was a Senior Mechanic with a oil refinery. His duties included maintenance and repair of motors, pumps, piping, filters, and valves and new construction. On the day of the accident, plaintiff was setting up equipment to drill through the cement floor on the second floor of the Blending Department at the refinery. This task included dragging a water hose through existing stationery equipment. As he began to pass through the equipment, his right foot caught in a 1.5 inch steam hose that had been left in a pile in the walkway. The steam hose was supposed to be rolled on a rack. When his foot caught, he fell forward, bashing his hard hat onto a pipe in front of him and falling to the floor. He suffered severe spinal injuries. Plaintiff sued defendant for negligently failing to keep a safe work environment.

Summary:
Plaintiffs sued their former certified public accountant for mistakes he made in preparing their income tax returns and financial statements. Charlene Doe v. Medical Manufacturer, Inc.
Summary:
Plaintiff worked as a registered nurse at U.C Davis Medical Center for 12 years. Her daily duties included starting I.V.s for patients. As part of her job, she was called to insert an I.V. into a high risk patient. To do so, she used a catheeter manufactured by the defendant. When the catheter unexpectedly malfunctioned, plaintiff was stuck by the needle. Within a month, she developed acute Hepatitis C. Plaintiff sued the manufacturer of the catheter alleging that it was negligently manufactured.

Kelly Doe v. Doe Apartments
Summary:
The plaintiff lived in defendant's apartment complex in a first floor apartment with a sliding glass door that led from the apartment to her patio which was separated from the parking lot by a wooden gate. Because the plaintiff did not own a car, she seldom used the sliding door to access the parking lot and she rarely walked from her patio into the parking lot at night. One night, the plaintiff walked out of her sliding glass door toward the parking lot. None of the three lights that should have illuminated the parking lot were lit. Plaintiff tripped over a parking berm and suffered a dislocated knee, fractured femur, ligamental knee disruption, and sensory loss on the top of her foot.

Alvin Doe v. Truck Rental Company and Moving Company
Summary:
Moving Company rented a truck from Truck Rental Company.  Moving Company’s driver set the parking brake on the truck and parked it on a hill at a gas station.  After 15 minutes, the driver returned to the truck and tried to start it without success.  As a result, the truck rolled downhill, directly into an area where Alvin Doe was servicing equipment at the gas station.  Although Alvin Doe had placed cones and caution tape around his work area, the truck driver aimed the runaway truck straight towards the work area and knocked plaintiff down.  He suffered left knee injuries as a result, which required four operations.  Plaintiff sued Truck Rental Company for failing to properly service and maintain the truck’s brakes and sued Moving Company because its driver was negligent for aiming the runaway truck at a clearly cordoned off work zone.

Summary:

Sharon Doe v. Roller Rink
Summary:
Sharon Doe attended a party at Roller Rink.  A 4 inch wide gap existed between the wooden skating rink floor and a DJ booth next to the rink.  During the party, the DJ called the skaters toward his booth to play a game.  As Sharon Doe approached the booth, her skate fell into the gap, causing her to fall and shatter her left wrist.  Doctors repaired the wrist by surgically installing a rod and four pins.  Roller Rink claimed that the gap was necessary to allow the wooden rink floor to expand and contract depending on the weather.

Summary:
Homeowner owned a dog with violent tendencies.  In the past, it had bitten its owner and snapped at the owner’s gardener and housekeeper.  Ten year old Taylor Doe and her mother were guests at Homeowner’s home.  Homeowner never warned plaintiff or her mother about the dog’s vicious propensities.  When plaintiff approached the dog and tried to hug it, the dog attacked plaintiff, causing serious cuts to her forehead and lip.  She required emergency surgery on the night of the attack and will require two more surgeries in the future.
