Practice Areas

Our firm specializes in certain practice areas so that we can offer skilled and experienced representation. Below are summaries of our general practice areas. To read more about each area, please click on the practice area title.

Premises Liability / Slip and Fall
A dangerous condition on property may lead to an injury. The dangerous condition may be the result of a natural condition of the property or an artificial one created on the property by the owner, lessor, or occupant. Liability for dangerous property is known as "premises liability." The property may be a residential home, construction site, public area, commercial premises, or any other type of property. The dangerous condition is one that poses an unreasonable risk of harm to individuals that are on the premises, and may involve structural design flaws, unsafe conditions, environmental hazards, improper traffic patterns and a wide range of other issues.

Construction Accidents / Work Injuries
This is a general category encompassing a wide array of industrial construction accidents and other work-related injuries. Construction accidents may occur at residential or commercial construction projects, refinery projects, elevator construction projects, renovations, etc. They may include falls from heights, scaffolding accidents, accidents involving heavy equipment, or machinery. Often, these injured persons are members of heavy industrial unions such as the elevator constructors, iron workers, laborers, pile drivers, operating engineers, boilermakers, electricians, carpenters, etc. We also handle work-related accidents arising from injuries that occur at work but that are the fault of someone other than the employer.

Car Accidents / Bicycle Accidents / Pedestrian Accidents
Serious car and other motor vehicle accidents require the guidance of an experienced attorney. These cases arise out of injuries that occur on the road, whether the injured party was in a car, on a bicycle, or a pedestrian. Sometimes these cases arise when the person who caused the injury does not have adequate insurance. In such cases, the injured person may be able to make a claim against their own uninsured motorist or underinsured motorist insurance coverage. Balamuth & Balamuth works with physicians and other healthcare providers to assess and review all aspects of your injuries and the long term impact they will have on you. Our lengthy experience with both medicine and California’s automobile, insurance and liability laws means we understand how to prove the full extent of your injuries and find all possible sources of recovery available to compensate you for the damages you have suffered and will continue to suffer in the future.

Medical Malpractice / Doctor Negligence
These cases involve the negligence of a "healthcare provider." Health care providers include physicians, osteopaths, dentists and other practitioners in the health and medical industries. These professionals can be held liable if their actions or omissions fall below the standard of care required of their particular practice area and cause an injury. Balamuth & Balamuth has ample experience handling cases against professionals who have been negligent.

Legal Malpractice / Accountant Negligence
Professional negligence of an attorney or an accountant is the failure to use the skill and care that a reasonably careful attorney or accountant would use in similar circumstances.

Product Liability
Injuries may result from unsafe products which may be defective because of the way they are designed or manufactured or because they have inadequate warning labels. "Products" include any manufactured item: toys, heavy machinery, tools, food products, cars, household appliances, etc.

Wrongful Death
A wrongful death case is one where the family members of a decedent file a lawsuit claiming the decedent's death was someone’s fault. A wrongful death suit is different from other types of personal injury claims because the actual victim, the decedent, is not bringing the claim. A wrongful death claim is brought to recover damages for the injuries that the surviving family and/or estate have suffered due to the death of the victim. The purpose of a wrongful death suit is to provide relief to family members who have been injured emotionally and financially as a result of the family member’s death.
