Johnnie, an out-of-state, self-employed contractor without medical insurance, was working in the Bay Area on a time-sensitive remodeling project. As such, he was not able to see a doctor for his neck and back pain until more than three weeks after the crash. Defendant argued that Johnnie was not seriously injured because he continued to work on the remodeling project and took so long to seek medical treatment. They also argued that the impact of the crash was not significant as Johnnie's three passengers suffered only minor injuries. Johnnie's cervical spine injuries from the crash required a four level fusion, which was held in place by a plate and seven screws.

As a result, the truck rolled downhill, directly into an area where Alvin Doe was servicing equipment at the gas station. Although Alvin Doe had placed cones and caution tape around his work area, the truck driver aimed the runaway truck straight towards the work area and knocked plaintiff down. He suffered left knee injuries as a result, which required four operations. Plaintiff sued Truck Rental Company for failing to properly service and maintain the truck's brakes and sued Moving Company because its driver was negligent for aiming the runaway truck at a clearly cordoned off work zone.
