California’s Protection for Victims

California Civil Code Section 3342 states that "The owner of any dog is liable for the damages suffered by any person who is bitten by the dog while in a public place or lawfully in a private place, including the property of the owner of the dog, regardless of the former viciousness of the dog or the owner's knowledge of such viciousness."

This means that the animal does not have to have a history of aggression or attacks for the owner to be liable. So long as the attack falls under the rules provided by the law, the injured person can file a lawsuit in order to be paid for injuries, medical care, emotional suffering, and other financial losses.

The Keys to Proving Fault

Owners of dogs who have bitten someone must pay to cover the losses that his or her animal has caused. However, it must be proven that this is true. In order to do so, victims and their representation must prove a few key factors.

  • The dog in question was the one that bit. This can be proven through witness testimony and evidence found at the scene of the incident.
  • The identity of the owner. The animal may not be at its own home or may be on the loose. In any case, documents of purchase can link the person to the dog.
